The analysis of court decisions in the individual types of disputes over protection of rights to marks for goods and services reviewed by author allowed to detect factual circumstances, which are included in the fact detection in disputes about invalidation of the certificate of marks for goods and services? and in disputes about infringement of the certificate owner rights which origin on the basis of identical or misleadingly similar marks.
